The prosecution system of Tajikistan consists of the General Prosecutor’s Office, territorial subdivisions, and specialized prosecutors’ offices. Its main tasks are to protect democratic values, law and order, human rights and freedoms, the interests of the state and society, as well as to identify and prevent offenses and fight crime.
The primary areas of activity of the General Prosecutor’s Office of Tajikistan and its subordinate agencies include fighting against crime, corruption, terrorism and extremism, protecting the rights and legitimate interests of citizens, and ensuring the unity of the country’s legal framework. The prosecution authorities of Tajikistan coordinate the activities of law enforcement agencies and participate in court hearings.
The history of the modern prosecution system of Tajikistan dates back to the Soviet era. In October 1924, the Tajik Autonomous Soviet Socialist Republic (Tajik ASSR) was created within the Uzbek Soviet Socialist Republic. A month later, the Revolutionary Committee of the Uzbek SSR issued a decree establishing the Revolutionary Committee of the Tajik ASSR (essentially the provisional government of Tajikistan).
On December 14, 1924, the Tajik Revolutionary Committee created the People’s Commissariat of Justice and the State Prosecutor’s Office within the Commissariat. It is considered the beginning of the modern prosecution system of Tajikistan. In 1929, the Tajik ASSR was transformed into a full-fledged constituent republic of the Soviet Union – the Tajik Soviet Socialist Republic – and its prosecutor’s office was restructured.
In the 1930s, the prosecutor’s office of the Tajik SSR was separated from the People’s Commissariat of Justice and became directly subordinate to the General Prosecutor of the USSR. As of 1964, the prosecution authorities of the Tajik SSR consisted of the republican prosecutor’s office with 8 departments and 42 subordinate prosecutor’s offices (city, district, military, etc.).
In 1991, Tajikistan proclaimed its independence from the Soviet Union. The prosecutor’s office of a newly independent Tajikistan was created by the law “On Prosecutor’s Office of the Republic of Tajikistan” that was adopted on March 14, 1992 and came into effect on April 30, 1992. It was later replaced by the constitutional law “On Prosecutor’s Office of the Republic of Tajikistan” adopted in 1996 and amended in 2005.
Prosecutor’s Office Employees Day used to be celebrated on December 14 to commemorate the formation of the State Prosecutor’s Office of the Tajik Autonomous Soviet Socialist Republic. However, it was moved to March 14 in 2015 in order to cut ties with the country’s Soviet past and commemorate the formation of the prosecutor’s office in independent Tajikistan.
